Please read the following terms, conditions, waivers and indemnities carefully before submitting your application.

Terms, conditions, waivers & indemnities

The following terms and conditions have been drafted for and on behalf of Invictus Combat Karate-Jutsu for the purpose of protecting the organisation, its instructors, officials, representatives, and affiliated bodies from any and all legal claims arising from participation in any activities organised, hosted, or sanctioned by the organisation. All members, and where applicable, their parents or legal guardians, are required to read and accept each clause.

Clause 1 — Affiliation and registration

  1. By completing and signing this form, the member (and/or the parent/legal guardian, where applicable) agrees to formally register and affiliate with Invictus Combat Karate-Jutsu, an organisation affiliated to Shukokai Shito-Ryu.
  2. Membership is subject to the rules, regulations, and codes of conduct prescribed by Invictus Combat Karate-Jutsu and, where applicable, by the affiliated body Shukokai Shito-Ryu.
  3. Membership shall only be confirmed upon receipt of the duly completed and signed affiliation form, the required photographs, and full payment of the annual affiliation fee.
  4. No member shall be permitted to participate in any grading, tournament, Karate Camp (Gashkyu), competition, or special event without a valid and current affiliation.

Clause 2 — Annual affiliation fee

  1. Every member is required to pay an annual affiliation fee of R300.00 (three hundred rand) per annum.
  2. This fee is non-negotiable, non-refundable, and is payable in full upon joining or renewal, irrespective of the month or time of year in which the member joins or renews. No pro-rata reduction or discount shall be applicable regardless of the date of affiliation within the calendar year.
  3. The annual affiliation fee is separate from and in addition to any monthly tuition fees payable to the dojo or instructor.
  4. The organisation reserves the right to review and adjust the annual affiliation fee with reasonable prior notice to members.

Clause 3 — Monthly membership fees, training schedule & private lessons

  1. The monthly membership fee is R350.00 (three hundred and fifty rand) per student, payable in advance within the first week of each calendar month.
  2. The monthly membership fee of R350.00 grants the member the following entitlements:
    1. Access to the gym facility during all advertised open hours, subject to the organisation’s gym rules and the availability of the facility;
    2. Attendance of scheduled karate lessons in accordance with the training timetable set out in clause 3.3 below.
  3. The standard training schedule is as follows:

Beginners & juniors Mondays and Wednesdays 16:30 – 18:00
Seniors & advanced students Tuesdays and Thursdays 16:30 – 18:00
All ages & belt grades (mixed class) Saturdays 10:00 – 12:00
  1. The Saturday session is open to all members regardless of age or belt grade. Beginners, juniors, seniors, and advanced students train together under the supervision of the instructor. This session forms part of the standard monthly membership and does not attract any additional fee.
  2. Class placement for weekday sessions (beginners/juniors or seniors/advanced) shall be determined by the instructor at their sole discretion, based on the member’s age, grade, and level of experience.
  3. The organisation reserves the right to modify, cancel, or reschedule training sessions and gym access hours due to public holidays, load-shedding, facility maintenance, instructor unavailability, or any other reason, without liability to the member. Where reasonably possible, members will be notified in advance of any such changes.
  4. Absence from training sessions for any reason whatsoever — including illness, travel, personal circumstances, or otherwise — shall not entitle the member to any refund, credit, or discount on fees already paid.
  5. Private one-on-one lessons are available at a rate of R500.00 (five hundred rand) per session, conducted personally by Sensei Jimmy Janvier Nzabanterura. Private lessons are subject to availability and must be booked and confirmed in advance with Sensei Nzabanterura directly. The R500.00 session fee is payable prior to or on the day of the lesson and is non-refundable in the event of cancellation by the member with less than 24 (twenty-four) hours’ notice.
  6. In the event of non-payment of monthly fees, the organisation reserves the right to suspend or terminate the member’s access to the gym, training sessions, and all other activities until all outstanding amounts have been settled in full.
  7. Should the member wish to terminate their membership, they are required to provide one (1) calendar month’s written notice to the instructor. Membership fees for the notice period shall remain payable in full.
  8. All amounts outstanding at the time of termination shall remain due and payable notwithstanding the termination of membership.

Clause 4 — Assumption of risk and voluntary participation

  1. The member (and/or parent/legal guardian, where applicable) acknowledges and accepts that martial arts, karate, and all forms of contact sport and physical training carry an inherent risk of physical injury, including but not limited to bruising, sprains, fractures, concussion, muscle tears, joint injuries, and in extreme cases, permanent disability or death.
  2. The member voluntarily and freely chooses to participate in all training sessions, grading examinations, Karate Camps (Gashkyu), competitions, demonstrations, tours, and any other activity organised or sanctioned by Invictus Combat Karate-Jutsu, with full knowledge of, and acceptance of, these inherent risks.
  3. This voluntary assumption of risk applies to all activities conducted:
    1. On the premises of any dojo affiliated with Invictus Combat Karate-Jutsu;
    2. In the gym facility during open hours;
    3. At any venue or facility used for Karate Camps (Gashkyu), whether within or outside the Republic of South Africa;
    4. At any tournament venue, competition arena, or event venue, whether affiliated or non-affiliated;
    5. During transportation to and from any officially sanctioned event;
    6. At any location in which an activity is carried out under the authority or direction of Invictus Combat Karate-Jutsu or its instructors.
  4. The member further acknowledges that risks may arise from the actions of other participants, third parties, equipment failure, venue conditions, weather, or circumstances beyond the reasonable control of the organisation.

Clause 5 — Indemnity and waiver of liability

  1. In consideration of being permitted to participate in all activities organised, hosted, sanctioned, or attended by Invictus Combat Karate-Jutsu, the member (and/or the parent/legal guardian, where applicable) irrevocably and unconditionally indemnifies and holds harmless the following parties against any and all claims, demands, actions, proceedings, liabilities, losses, damages, costs, expenses, or legal fees of whatsoever nature and howsoever arising:
    1. Invictus Combat Karate-Jutsu and its founders, directors, officers, and management;
    2. All instructors, coaches, senseis, and assistant instructors affiliated with or employed by the organisation, including Sensei Jimmy Janvier Nzabanterura;
    3. All officials, referees, graders, judges, and event organisers acting on behalf of the organisation;
    4. Shukokai Shito-Ryu and its national and international affiliates and representatives;
    5. Any venue owner, facility manager, or property owner at which an affiliated event is held, including the gym facility;
    6. All volunteers, helpers, and support staff operating under the direction of the organisation.
  2. This indemnity applies to, but is not limited to, any injury, loss, damage, or death arising from or in connection with:
    1. Regular training sessions — including sparring (kumite), kata practice, bag work, fitness conditioning, self-defence techniques, and any other component of regular dojo training;
    2. Gym use — including all use of gym equipment, free weights, cardio equipment, and any other facility during open gym hours;
    3. Private one-on-one lessons — including all activities undertaken during sessions conducted by Sensei Jimmy Janvier Nzabanterura or any other designated instructor;
    4. Grading examinations — including all physical requirements, techniques, and assessments conducted during belt grading;
    5. Karate Camps (Gashkyu) — including all training activities, accommodation, meals, recreational activities, and transportation forming part of the camp programme, whether conducted indoors or outdoors, during the day or at night;
    6. Tournaments and competitions — including local, regional, national, and international kumite and kata competitions of any format or rules system;
    7. Demonstrations and exhibitions — including public performances, school demonstrations, corporate events, and media-related appearances;
    8. Special training sessions and seminars — including guest instructor sessions, cross-training, and any other training activities outside the normal programme;
    9. Tours and travel — including any training tours, competitions, or camps conducted domestically or internationally;
    10. Any other activity sanctioned, organised, or participated in under the banner or authority of Invictus Combat Karate-Jutsu.
  3. The member acknowledges that this indemnity and waiver of liability shall apply whether the injury, loss, or damage is caused by the negligence, act or omission of the organisation, its instructors, officials, or representatives, or whether it results from the member’s own actions or those of a third party, save for instances of gross negligence or wilful misconduct by the organisation.
  4. This clause constitutes a volenti non fit injuria agreement under South African law, and the member confirms that they are signing freely, voluntarily, and without duress.

Clause 6 — Medical declaration and fitness to participate

  1. The member declares that, to the best of their knowledge, they are in good physical health and are physically capable of participating in martial arts training and all related activities.
  2. The member undertakes to immediately inform their instructor of any medical condition, injury, illness, or physical limitation — whether arising before or after joining — that may affect their ability to safely participate in training or any other activity.
  3. The member accepts full responsibility for ensuring that they are medically fit to participate and acknowledges that it is their responsibility, and not that of the organisation, to consult a medical practitioner where necessary.
  4. In the event of a medical emergency arising during any activity organised by Invictus Combat Karate-Jutsu, the member (and/or the parent/legal guardian, where applicable) consents to the organisation or its designated representative arranging immediate emergency medical treatment on the member’s behalf, including transportation to the nearest medical facility. Where a medical aid is registered on this form, the organisation is authorised to present the member’s medical aid details to any treating medical facility or emergency services provider.
  5. The member (and/or parent/legal guardian) accepts full financial responsibility for all medical, ambulance, hospital, and related expenses arising from such emergency treatment that are not covered by the member’s medical aid. The organisation shall not be liable for any such costs.
  6. The member confirms that all medical and medical aid information disclosed on this form is accurate and complete, and undertakes to keep this information updated should any changes occur.

Clause 7 — Karate Camps (Gashkyu) — specific provisions

  1. Participation in any Karate Camp (Gashkyu) organised or sanctioned by Invictus Combat Karate-Jutsu is subject to the following additional conditions:
    1. All members attending a Gashkyu must have a current and valid affiliation.
    2. Written consent from the parent/legal guardian is required for all members under the age of 18 years prior to attendance at any Gashkyu.
    3. Members are required to comply with all camp rules, schedules, curfews, and codes of conduct for the duration of the camp.
    4. Invictus Combat Karate-Jutsu reserves the right to send home, at the member’s or parent/guardian’s expense, any member who fails to comply with camp rules or whose behaviour is deemed disruptive, dangerous, or inappropriate.
    5. The organisation shall not be held liable for any loss, theft, or damage to personal property during a Gashkyu.
    6. The organisation shall not be held liable for any illness, injury, or adverse event occurring during a Gashkyu, whether during training, recreational activities, meals, or overnight periods.

Clause 8 — Tournaments and competitions — specific provisions

  1. The member acknowledges and accepts that tournaments and competitions, by their nature, carry a heightened level of physical contact and risk compared to regular training.
  2. The member (and/or parent/legal guardian) indemnifies the organisation, event organisers, referees, and officials against any injury sustained during any competitive bout, match, or event, including injuries caused by opposing competitors.
  3. All competitors are required to wear the protective equipment prescribed by the applicable competition rules. Failure to do so may result in disqualification. The organisation accepts no liability for injuries sustained as a result of failure to wear prescribed protective equipment.
  4. The organisation reserves the right to withdraw any member from a competition on the advice of the instructor or a medical professional, in the interests of the member’s safety.
  5. The member accepts that decisions made by referees, judges, and officials during competitions are final and binding, and agrees not to pursue any legal action arising from competition decisions or outcomes.

Clause 9 — Code of conduct

  1. The member agrees to conduct themselves at all times in accordance with the principles of Invictus Combat Karate-Jutsu, which are rooted in the values of honour, discipline, balance, and evolution.
  2. The member agrees to:
    1. Treat all instructors, fellow students, officials, and members of the public with respect and dignity;
    2. Refrain from using martial arts techniques in a reckless, irresponsible, or unlawful manner;
    3. Comply with all dojo and gym rules, training protocols, and instructions given by instructors and officials;
    4. Behave appropriately at all events, venues, camps, and tournaments conducted under the organisation’s banner;
    5. Refrain from any behaviour that may bring the organisation, Shukokai Shito-Ryu, or the martial arts community into disrepute.
  3. The organisation reserves the right to suspend or permanently terminate the membership of any member who violates the code of conduct. No refund of fees shall be payable in such circumstances.

Clause 10 — Photographic and video consent

  1. The member (and/or parent/legal guardian, where applicable) consents to Invictus Combat Karate-Jutsu and its authorised representatives photographing and/or recording video footage of the member during training sessions, gradings, Gashkyu, competitions, demonstrations, and any other affiliated events.
  2. The member further consents to the use of such photographs and/or video footage for the purposes of marketing, social media, website content, press releases, promotional materials, and any other communication by the organisation or its affiliates.
  3. Should the member wish to withhold consent for photographic or video use, they must notify the organisation in writing at the time of signing this form. The organisation will make reasonable efforts to honour such requests; however, in a group setting, total exclusion cannot always be guaranteed.
  4. No compensation shall be payable to the member for the use of such photographs or video footage.

Clause 11 — Gradings, tournaments and special events — eligibility

  1. No member shall be permitted to participate in any belt grading examination, tournament, Gashkyu, competition, demonstration, or special training session unless:
    1. They hold a current and valid affiliation with Invictus Combat Karate-Jutsu for the applicable year;
    2. Their annual affiliation fee of R300.00 has been paid in full;
    3. All outstanding monthly membership fees have been settled;
    4. They are in possession of their official Invictus Combat Karate-Jutsu affiliation record/booklet.
  2. Invictus Combat Karate-Jutsu reserves the right to refuse participation to any member who does not meet the eligibility criteria above, without liability for any loss or inconvenience suffered by the member.

Clause 12 — Protection of personal information (POPIA)

  1. Invictus Combat Karate-Jutsu is committed to the protection of personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA).
  2. Personal information collected on this form shall be used solely for the purposes of:
    1. Processing and managing membership and affiliation;
    2. Communication regarding training, events, competitions, and camps;
    3. Emergency medical purposes, including the presentation of medical aid details to treating facilities;
    4. Affiliation administration with Shukokai Shito-Ryu.
  3. The member’s personal information shall not be sold, shared, or disclosed to any third party without consent, except where required by law or for purposes directly related to affiliation administration.
  4. The member has the right to access, correct, or request the deletion of their personal information by submitting a written request to the organisation.

Clause 13 — Dispute resolution

  1. In the event of any dispute arising from or in connection with this agreement, the member agrees to first attempt to resolve the matter amicably with the organisation through written notice and good-faith discussions.
  2. Should the dispute remain unresolved after 30 (thirty) calendar days from the date of written notice, the parties agree to submit the dispute to binding arbitration in accordance with the rules of the Arbitration Foundation of Southern Africa (AFSA), or such other arbitration body as the parties may agree upon.
  3. This agreement shall be governed by and construed in accordance with the laws of the Republic of South Africa, and the parties consent to the non-exclusive jurisdiction of the courts of KwaZulu-Natal, Durban for any matters that cannot be resolved through arbitration.

Clause 14 — General provisions

  1. Entire agreement: This form, together with any dojo-specific rules or additional event-specific waivers, constitutes the entire agreement between the parties with respect to affiliation and participation in Invictus Combat Karate-Jutsu activities.
  2. Severability: If any provision of this agreement is found to be invalid, unlawful, or unenforceable, such provision shall be severed from the remainder of the agreement, which shall continue to be valid and enforceable to the fullest extent permitted by law.
  3. Amendments: The organisation reserves the right to amend its rules, regulations, and affiliation terms at any time. Members will be notified of material changes in writing or by way of notice at the dojo. Continued participation following such notice constitutes acceptance of the amended terms.
  4. No waiver: The failure of the organisation to enforce any provision of this agreement at any time shall not be construed as a waiver of its rights to enforce such provision at a later date.
  5. Minors: Where the member is under 18 years of age, the parent or legal guardian signing this form confirms that they have full legal authority to sign on behalf of the minor and to bind the minor to the terms herein.
